These Terms & Conditions (“Terms”) govern the use of the ordering and delivery services (“Service”) provided by Discount Fuels (“we,” “us,” or “our”). By placing an order through our website, you agree to these Terms.
1. Ordering, Payment & Pre-Authorization
1.1 Pre-Authorization of Funds
When you place an order, your payment method is pre-authorized for the estimated cost of delivery. This is not a final charge.
1.2 Final Charge
After delivery, we will charge you for the actual volume of furnace oil delivered.
- If your tank cannot safely accept the full amount you ordered, you will be charged only for what is delivered.
- You will never be charged more than the pre-authorized amount.
1.3 Pre-Authorization Hold Period
Pre-authorized funds remain on hold until the delivery is completed or until the hold reaches the maximum allowable duration set by your card provider, whichever comes first. If the hold expires, a new authorization may be required before delivery can proceed.
1.4 Currency
All pricing, charges, and refunds are processed in Canadian Dollars (CAD).
1.5 Delivery Volume Obligation
Our delivered volume will be up to the full pre-authorized amount based on the pricing for the date of delivery. You are solely responsible for determining how much oil you need and whether the ordered amount is sufficient for your heating requirements. We do not assess tank levels, tank capacity, or your fuel needs.
1.6 Minimum Order Quantity & Delivery Fee
The minimum order quantity is $500 (pre-authorized amount). Deliveries of less than 300 litres may be subject to an additional fee at our discretion.
1.7 Payment Failure
If the pre-authorized charge cannot be processed, delivery will not be initiated. You will receive notice from our website when an order has not been processed. It is your responsibility to ensure the order has been processed through our website.
2. Pricing
2.1 Prices May Fluctuate
Prices shown at the time you place an order are not guaranteed. The final price is based on the rate in effect on the delivery date.
2.2 Market Changes
Prices may change due to market conditions, supply factors, taxes, or surcharges.
3. Cash or Card at the Door
3.1 Customer Must Be Present
If you select Cash at Door or Interac at Door, you must be present for delivery.
- If you are not present, delivery will not occur.
- We will attempt to contact you to reschedule, but delays are possible.
3.2 No Liability for Missed Appointments
We are not responsible for delays caused by customer absence.
4. Delivery Timing & Customer Responsibility
4.1 No Liability for Delays
We are not liable for any damages or losses caused by delivery delays. This includes, but is not limited to:
- Running out of oil
- Damage to heating systems
- Alternative heating costs
- Emergency service costs
4.2 Customer Responsibility for Fuel Levels
You are responsible for:
- Monitoring your fuel levels
- Determining how much oil you need
We do not guarantee that the amount delivered, up to your pre-authorized limit, will meet your needs.
4.3 Customer Acknowledges Risk of Running Out of Oil
By placing an order, you acknowledge that running out of oil is your responsibility, and we are not liable for any resulting damage, system failures, or costs.
5. Accessibility Requirements
5.1 Access to Tank and Fill Pipe
You must ensure that your tank and/or fill pipe are fully accessible on the day of delivery, including clearing snow, ice, debris, and ensuring gates or enclosures are unlocked. Pets must be secured.
5.2 Inaccessible Equipment
If we cannot safely access the tank and/or fill pipe, delivery may be postponed and additional fees may apply.
6. Safety Conditions
6.1 Right to Refuse Service
We may refuse or stop a delivery if conditions are unsafe or if proceeding could cause damage or personal injury.
6.2 Right to Inspect
We reserve the right to conduct a visual inspection of the tank and/or piping system before delivery:
- Outside tanks: We may inspect the tank body, vent, fill pipe, and visible condition.
- Inside tanks: We may inspect the piping, venting, access, and other visible components outside of your home. We do not conduct visual inspections of inside tanks.
Inspections are visual only and do not predict future failures.
6.3 Right to Refuse Delivery
We may refuse or stop delivery if:
- The tank or piping appears unsafe
- The vent whistle does not sound (No Whistle, No Fill)
- There are signs of leaks, corrosion, structural weakness, or improper installation
- Safety or code requirements are not met
6.4 Liability for Refusal
We are not responsible for delays caused by refusal due to safety or compliance issues.
6.5 Tank Condition
We are not responsible for issues related to the condition of your tank, fill pipe, or system, including leaks, contamination, and/or structural defects.
7. Environmental Liability & Indemnification
7.1 Environmental Risks
You are responsible for the condition of your tank, venting, and piping.
7.2 Indemnification
You agree to indemnify, defend, and hold harmless Discount Fuels from all costs, damages, claims, or liabilities arising from:
- Leaks, spills, or environmental contamination caused by your tank or piping
- Improper venting, non-functional whistle, or unsafe delivery conditions
- Tank or piping failures before, during, or after delivery
- Non-compliance with fuel storage regulations
This indemnification survives termination of service.
8. Order Changes & Cancellations
8.1 Customer Initiated
Changes You may request changes or cancellation prior to delivery. Changes may affect pricing and timing. If you cancel before delivery, we will issue a full refund.
8.2 Company Initiated
Changes We may cancel or reschedule deliveries due to weather, safety concerns, operational issues, or legal requirements.
8.3 Refunds When Delivery Cannot Be Fulfilled
If we are unable to complete a delivery for reasons not caused by the customer, we will refund the full pre-authorized amount.
9. Privacy & Data Protection
9.1 Protection of Information
All information entered through our website is protected using industry-standard security measures.
9.2 Legal Compliance
We collect and handle personal information in accordance with all applicable Canadian federal and provincial privacy laws.

10. Website Use
You agree not to misuse the website, disrupt its operation, attempt unauthorized access, or engage in any activity that interferes with system integrity or security.
11. Limitation of Liability
11.1 Limitation of Liability
To the fullest extent permitted by law, Discount Fuels is not liable for direct, indirect, incidental, or consequential damages arising from:
- Delivery delays
- Price changes
- Running out of oil
- Tank or system failures
- Missed appointments
- Inaccessible delivery location
- Website errors or outages
Your sole remedy for any claim related to our Service is limited to the amount paid for the specific delivery in question.
11.2 Indemnification
You agree to indemnify and hold harmless Discount Fuels from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising from:
- Your breach of these Terms
- Unsafe or inaccessible delivery conditions
- Misrepresentation of property or tank condition
- Negligence, misconduct, or misuse of equipment
- Improper use of the website or Service
This obligation continues even after service has ended.
12. Entire Agreement & Dispute Procedure
12.1 Entire Agreement
These Terms constitute the entire agreement between you and Discount Fuels and override all prior verbal or written communications.

13. Governing Law
These Terms are governed by the laws of the Nova Scotia, along with applicable laws of Canada.
